1. Agreement to Terms

By accessing or using FieldMarshal ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

FieldMarshal is a scheduling and booking management tool for independent home service professionals. These terms govern your use of our platform and subscription.

2. Subscription & Billing

• →Free Trial: Your subscription begins with a 3-day free trial. Your payment method is collected at signup but you will not be charged during the trial period.
• →Auto-Billing: After the 3-day trial, your payment method will be automatically charged $29.00 USD per month unless you cancel before the trial ends.
• →Recurring Charges: Subscriptions renew monthly on the same date each billing cycle. You authorize FieldMarshal to charge your payment method on a recurring basis.
• →Pricing Changes: We may change subscription pricing with 30 days advance notice via email.
• →No Refunds: Payments are non-refundable except where required by applicable law. If you cancel mid-cycle, you retain access through the end of the paid period.

3. Cancellation

You may cancel your subscription at any time from your dashboard with one click — no phone calls, no forms, no friction. Cancellation takes effect at the end of your current billing period. Your account and data remain accessible until then.

To cancel: log into your FieldMarshal dashboard and select "Cancel Subscription." If you experience issues cancelling, contact us at support@fieldmarshal.app.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information during registration and keep it current.

You may not share your account with others or use the Service for multiple businesses under a single subscription. One subscription covers one business operation.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• •Use the Service to transmit spam or unsolicited communications
• •Attempt to reverse engineer, copy, or create derivative works of the Service
• •Use automated means to access the Service beyond what we provide
• •Violate any applicable local, state, national, or international law
• •Upload content that infringes intellectual property rights of others

6. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind, express or implied. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of your data. We do not sell your personal information to third parties.

8. Intellectual Property

FieldMarshal and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or branding without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, FieldMarshal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

We may suspend or terminate your account for violations of these Terms, fraudulent activity, or for any other reason with reasonable notice. You may terminate your account at any time by cancelling your subscription and contacting us to request data deletion.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by applicable law.
